1. Acceptance of Terms

By accessing or using NexAPI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

NexAPI provides an API aggregation platform that allows developers to access multiple AI models through a single, OpenAI-compatible interface. The Service includes API access, usage monitoring, and billing management.

3. Registration and API Keys

You must register for an account to use the Service. You are responsible for maintaining the confidentiality of your API keys. Any activity under your API keys is your responsibility. You must notify us immediately of any unauthorized use.

4. Pricing and Payment

Service fees are based on token usage at the rates published on our pricing page. We reserve the right to change pricing with 30 days' notice. Payments are processed in USD. Prepaid balances are non-refundable unless required by applicable law.

5. Acceptable Use

You agree not to use the Service for any illegal activities, to generate harmful content, to violate any third-party rights, or to attempt to reverse engineer or disrupt the Service. We reserve the right to suspend or terminate accounts that violate these terms.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects service availability. We are not liable for any damages resulting from service interruptions.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXAPI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Termination

You may terminate your account at any time. We may terminate or suspend your account for violation of these terms, with or without notice. Upon termination, your right to use the Service ceases immediately.

9. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified terms.
